Welcome to PublicDisplay Agency Inc. By accessing or using our website and services, you agree to comply with and be bound by the following Terms of Service. If you do not agree to these terms, please do not use our website or services.

1. Services Provided

Our website provides the following services:

  • Artist registration and event participation management
  • Access to event-related content and artist profiles
  • Artist pages featuring user-submitted content, such as images and external links
  • Opportunities to support artists through our Tap to Support model

2. Artist Participation

Artists who exhibit at Public Display Agency Inc. events are provided with a professionally installed 10' x 6' display panel for a flat participation fee of $200.This fee includes access to:

  • Event promotion and marketing via PDA’s national channels
  • Electricity, event photography, and venue coordination
  • Ongoing visibility through the artist’s profile on PDA’s platform

Participation in our events implies a reasonable expectation that artists will:

  • Share their PDA artist profile with their audience and networks
  • Promote participation in the Tap to Support ecosystem, which fuels community contributions to the arts
  • Complete the onboarding process  to create a Stripe Connect account, enabling direct receipt of     supporter contributions

3. PDA Learning Community

The PDA LearningCommunity is a separate portal that requires user login to access courses and resources.By signing up, users agree to:

  • Maintain the confidentiality of their login credentials
  • Use the portal only for personal educational purposes
  • Refrain from sharing course materials without explicit permission

We will only contact users of the PDA Learning Community for:

  • New course offerings and promotions
  • Course completion reminders

4. User-Generated Content

Artists who upload content to their profiles retain full ownership of their work. By uploading content, you grant us a non-exclusive, royalty-free license to use, display, and promote your work in connection with your participation in PDA events.

5. Refund Policy

At Public DisplayAgency Inc., we aim to keep artist participation accessible and sustainable. Toensure fairness and event viability, we have established the following policy:

General Terms:

  • All participation fees are non-refundable.
  • By registering, artists acknowledge that their commitment secures event participation and cannot     be reversed.
  • No refunds will be issued for no-shows or missed events.

Event Cancellation or Rescheduling:

  • If PDA cancels an event, artists will be offered:
       
    • A full refund, or
    •  
    • A credit toward a future event.
  •  
  • If an event is rescheduled or postponed, the participation fee will be transferred to the new date or     held as credit. Refunds are not offered for rescheduling.

Special Circumstances:

  • Exceptions may be made in rare cases such as documented medical emergencies, at PDA’s sole discretion.
  • Requests must be submitted in writing no fewer than 10 days before the event.

Chargebacks & Disputes:

  • Disputes will be resolved according to Stripe’s payment processor policies.
  • Fraudulent chargebacks will be contested and may result in legal action.

6. Disclaimers

  • Artist Content: PDA does not claim ownership over any artwork or media submitted by participating artists.
  • Event Liability: While PDA carries general liability insurance, we are not responsible for personal loss, damage, or injury beyond the scope of our coverage.
  • Website Availability: We do not guarantee uninterrupted access to our digital platforms or services.

7. Event Photography

Events may be documented by PDA photographers for marketing and archival purposes. These images may include general event scenes, artists, and installations.

If you have concerns about your likeness being captured, please email us athelp@publicdisplayagency.ca in advance of the event. While we cannot guarantee exclusion from all images, reasonable accommodations will be considered.

8. Code of Conduct

PDA is committed to creating safe, inclusive, and respectful environments for all participants.

Expectations:

  • Treat others with dignity and respect.
  • No harassment, discrimination, or disruptive behavior will be tolerated.

Venue Conditions:

Participants agree to follow venue-specific rules, including:

  • No weapons or illegal substances
  • Compliance with age restrictions and accessibility requirements
  • Observance of noise restrictions and alcohol/smoking policies where applicable

Reporting:

Violations of thisCode should be reported to staff or emailed to help@publicdisplayagency.ca. PDA will take all reports seriously and may take action up to and including removal from the event without refund.

9. Limitation of Liability

To the maximum extent permitted by law, Public Display Agency Inc. is not liable for indirect, incidental, or consequential damages arising from the use of our website, services, or participation in events.

10. Governing Law

These Terms are governed by the laws of British Columbia and the federal laws of Canada.Disputes will be resolved in British Columbia courts.

11. Updates to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website with the updated effective date.
